AI Support and Customer Data: A Plain-Language GDPR Checklist for SMBs

Most SMBs using AI support don't have a GDPR problem. They have a documentation problem. They set up the chatbot, tested a few conversations, and went live — without signing a Data Processing Agreement with their AI vendor, without updating their privacy notice, and without thinking about what happens when a customer asks for their data to be deleted.

GDPR doesn't prohibit AI customer support. Article 6 gives you multiple lawful bases to process customer messages. What the regulation requires is that you know how data flows through your setup, that your customers know an AI is handling their queries, and that you've made written agreements with every vendor that touches that data. Most SMBs haven't done any of the three.

The fine risk is real. GDPR enforcement isn't limited to large corporations — the Irish DPC and the French CNIL regularly issue penalties to businesses with under 50 employees. The maximum is €20 million or 4% of global annual turnover, but even smaller fines in the €5,000–€50,000 range can be genuinely damaging when you're running on thin margins. Does GDPR Actually Cover an AI Chatbot?

Yes — from the first message. Under GDPR Article 4(1), personal data is any information relating to an identified or identifiable natural person. A customer's name, email address, order number, or even a description of their issue — "I'm having trouble logging in, my name is Sarah" — is personal data the moment it enters your chat system. Processing begins when the AI reads it and responds.

Three roles are relevant to your setup. You are the data controller — you determine the purpose and means of processing. Your AI vendor (the company providing the underlying language model) is a data processor — they process data on your behalf, under your instructions. If you use a platform that sits between you and the model, that platform is also a processor. Each of these relationships requires a written agreement under Article 28, and most SMBs have exactly none of them in place.

The lawful basis for most AI support is either contract performance (Article 6(1)(b), for customers querying you about a service they've paid for) or legitimate interests (Article 6(1)(f), for pre-sale queries and general support). You don't need to obtain consent to run a support chatbot. You do need to document which basis you're relying on — and that documentation needs to exist before a supervisory authority asks to see it.

The DPA Question: What to Ask Your AI Vendor

A Data Processing Agreement is a contract between you (the controller) and your vendor (the processor) specifying what data is processed, for what purpose, how long it's retained, and what security measures apply. Under Article 28, it's not optional. Running AI support without one isn't an administrative gap — it's a material GDPR violation.

Most established AI vendors have a standard DPA available, but you have to ask for it. If you're using a platform built on OpenAI's API, you need DPAs at both levels: one with the platform provider, one with OpenAI as the underlying processor. OpenAI offers a DPA for API customers covering Article 28 obligations and Standard Contractual Clauses for EU data transfers. Your platform provider should offer the same.

When reviewing any DPA, verify four things:

  • Sub-processor list: Who else does your vendor share data with? The DPA should name all sub-processors and require notice before adding new ones.
  • Data location: Where is customer data stored and processed? If outside the EEA, SCCs need to be in place. The EU-U.S. Data Privacy Framework (adopted July 2023) provides a valid adequacy mechanism for U.S. transfers, but only for vendors that are certified under it.
  • Retention and deletion commitments: Does the DPA specify how long the vendor holds message data, and can you request deletion?
  • Security obligations: The DPA should reference Article 32 and specify the technical and organizational measures in place.

If a vendor can't produce a DPA within 48 hours of being asked, treat that as a signal about how seriously they take compliance — before you've signed anything.

When human escalation is part of your support model, the escalation platform (your helpdesk or CRM) also processes personal data under your direction. That's a third processor relationship requiring its own DPA.


What the Transparency Obligation Actually Requires

Article 13 of GDPR requires that at the time personal data is collected, you inform customers about who is processing their data and why. When a customer types into your chat widget, you've started collecting personal data. The disclosure has to happen at that moment.

In practice, this means two things. First, your privacy notice must mention AI processing — it should name the category of processing, identify the vendor, and explain what happens to the data. Second, the chat interface itself should make clear that the customer is talking to an AI, not a human. A one-line notice in the widget header is sufficient: "Chatting with AI assistant — replies are automated."

The EU AI Act strengthens this. Under Article 52, AI systems designed to interact with humans must disclose their AI nature in a clear and timely manner. The provisions for "limited risk" AI — which covers most customer-facing chatbots — apply from August 2, 2026. After that date, failing to disclose means exposure under both GDPR and the AI Act simultaneously.

The implementation is genuinely simple. A line in the chat widget header and a paragraph in your privacy notice covers both obligations. Neither requires legal counsel to draft. What it does require is that someone actually writes it and puts it in the right place.


Why Data Retention Is the Gap Most SMBs Miss

Article 5(1)(e) requires that personal data be kept "no longer than is necessary for the purposes for which the personal data are processed." For AI support chat transcripts, that means a defined maximum retention period — and a mechanism to enforce it.

Most SMBs don't have one. Transcripts accumulate indefinitely in the platform, often containing names, account details, complaint descriptions, and payment queries. If you suffer a breach and your logs go back three years, your exposure is three years of data rather than 30 days. The IBM Cost of a Data Breach Report 2024 put the average breach cost at $4.88 million globally — a figure that scales down for SMBs but doesn't disappear.

A defensible retention policy for support chat typically looks like this:

Whatever period you choose, document it, communicate it in your privacy notice, and enforce it — either through automated deletion in your platform or a manual review on a defined schedule.

When a customer exercises their right to erasure under Article 17, you have one calendar month to delete their data from your platform, request deletion from your processors, and confirm it in writing to the customer. Having no retention policy makes that process significantly harder.

FAQ

Do I need customer consent to use AI for support?

No — not for standard support interactions. Consent is one of six lawful bases under Article 6, but it's rarely appropriate for customer support. It must be freely given, which is difficult to guarantee in a support context, and customers would have the right to withdraw it at any moment. Legitimate interests (Article 6(1)(f)) or contract performance (Article 6(1)(b)) are the correct bases for most AI support interactions. Document which one applies to your setup and why.

What if a customer asks to see all the data I hold on them?

That's a Subject Access Request under Article 15. You have one calendar month to respond with all personal data you hold on that individual — chat transcripts, account data, any notes added during escalation. If you use multiple platforms for support and CRM, data needs to be pulled from all of them. A documented SAR process is far faster to run than one built from scratch after the first request arrives.

Does GDPR apply if my business is outside the EU?

GDPR applies based on where your customers are located, not where you are. Under Article 3(2), the regulation covers any controller or processor outside the EU that offers goods or services to EU residents, or that monitors their behavior. If any of your customers are in EU member states, GDPR applies to how you handle their data. UK-based businesses operate under UK GDPR, which mirrors the EU regulation post-Brexit and carries the same obligations.

What happens if there's a data breach involving chat transcripts?

Under Article 33, you have 72 hours to notify your supervisory authority after becoming aware of a personal data breach that poses a risk to individuals. If the breach is likely to result in high risk to affected people, Article 34 requires you to notify those individuals directly. Document the breach, its scope, the data involved, and the steps taken. Regulators assess the response to a breach as closely as the breach itself — the 72-hour window is strict.

Can I use chat transcripts to improve or train my AI?

Only with a lawful basis and clear disclosure. If you use a platform running on a third-party API like OpenAI's, verify whether the vendor's standard agreement permits data use for training. Enterprise API agreements typically specify that customer data is not used to train the provider's models. If you want to use your own conversation data for fine-tuning, that requires a separate lawful basis — likely legitimate interests — and must be disclosed in your privacy notice before you start.

How do I handle AI support across multiple countries?

GDPR applies in the EU and EEA; UK GDPR applies in the United Kingdom. If you operate in both, the compliance obligations are nearly identical but technically separate regulatory frameworks. For customers in other jurisdictions, check whether a local equivalent applies — Brazil (LGPD), Canada (PIPEDA), California (CCPA) each have their own requirements. GDPR compliance for AI support is a documentation exercise, not a legal project. The underlying processing is almost certainly lawful — customers understand that typing into a chat widget means their message is being handled by a system.
